Frequently Asked Questions – UAE Labour Law

Explore common questions about our legal services.

UAE Labour Law is the legal framework that governs employment relationships in the private sector, including employment contracts, wages, working hours, leave, termination, and employee rights under Federal Decree Law No. 33 of 2021.

An employer cannot terminate an employee without valid legal reasons. Termination must follow proper procedures, and in most cases, a notice period is required unless the termination is for serious misconduct as defined by UAE law.

If you are unfairly dismissed, you may be entitled to:

  • Compensation for arbitrary dismissal
  • Unpaid salary and benefits
  • End-of-service gratuity
  • You can also file a complaint with MOHRE or the UAE Labour Court.

End-of-service gratuity is calculated based on your basic salary and length of service. Employees who complete one year or more of continuous service are generally entitled to gratuity under UAE Labour Law.

A UAE employment contract should include:

  • Job title and duties
  • Salary and allowances
  • Working hours
  • Probation period
  • Termination terms
  • Benefits and leave entitlement

An employer cannot unilaterally reduce your salary without your consent. Any salary change must be mutually agreed and documented in accordance with UAE Labour Law.

The probation period in the UAE can be up to six months. During this period, either party may terminate the contract with proper notice as per the law.

You can file a labour complaint through:

  • MOHRE (Ministry of Human Resources and Emiratisation)
  • Labour offices or online portals
  •
  • The case is usually first resolved through mediation before going to court.

es, you are entitled to salary for the period you worked. However, resignation during probation may affect notice requirements and future employment conditions depending on the situation.

Wrongful termination occurs when an employee is dismissed without valid legal reason or without following proper procedures under UAE Labour Law. In such cases, the employee may claim compensation.

If your employer delays or fails to pay your salary, you can file a complaint with MOHRE (Ministry of Human Resources and Emiratisation). UAE Labour Law protects employees’ right to timely payment, and employers may face penalties for salary delays.

An employee is generally required to serve the notice period stated in the employment contract. However, in certain legal situations such as employer breach of contract or serious violations, an employee may terminate the contract without notice in accordance with UAE Labour Law.
